HIPAA Notice of Privacy Practices

79th Street Pharmacy is required by law to maintain the privacy of your protected health information (PHI), to give you this Notice of our legal duties and privacy practices, to notify you following a breach of unsecured PHI, and to follow the terms of the Notice currently in effect.

• Treatment - to dispense your prescriptions, counsel you, check for interactions, and communicate with your prescribers and other providers involved in your care.
• Payment - to bill and collect from your health plan, verify coverage, obtain prior authorization support, and process manufacturer copay assistance.
• Healthcare operations - for quality assurance, staff training, licensing, audits, and business management.
• Appointment, refill, and pickup reminders - including calls, texts, or emails to the contact information you give us.
• Individuals involved in your care - a family member, friend, or caregiver picking up your medication, unless you object.
• As required by law - including public health reporting, the New York State Prescription Monitoring Program, FDA adverse event and recall reporting, health oversight activities, judicial or administrative orders, law enforcement requests permitted by law, reporting abuse or neglect, workers' compensation, coroners and funeral directors, organ donation, and to avert a serious threat to health or safety.

We will obtain your written authorization before using or disclosing PHI for marketing purposes, before any sale of PHI, and before disclosing psychotherapy notes. Most other uses not described in this Notice also require your authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted on it.

Certain categories of information - including HIV-related information, mental health information, substance use disorder treatment records, and genetic information - receive additional protection under New York and federal law, and we follow those stricter rules.

• Access and copies - to inspect and get a copy of your pharmacy records, including an electronic copy, generally within 30 days. A reasonable, cost-based fee may apply.
• Amendment - to ask us to correct information you believe is incorrect or incomplete. We may deny the request and will explain why in writing.
• Accounting of disclosures - to receive a list of certain disclosures we made in the six years before your request.
• Request restrictions - to ask us to limit what we use or disclose. We are not required to agree, except that we must agree to withhold information from your health plan for a service you paid for in full out of pocket.
• Confidential communications - to ask us to contact you at an alternate address or phone number.
• Paper copy - to receive a paper copy of this Notice at any time, even if you agreed to receive it electronically.
• Breach notification - to be notified if a breach of your unsecured PHI occurs.
• Choose someone to act for you - a personal representative with legal authority may exercise these rights on your behalf.

To exercise any right, contact our Privacy Officer using the information below. Requests for access, amendment, restriction, or confidential communication should be in writing.

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer, or with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, D.C. 20201, by calling 1-877-696-6775, or at hhs.gov/ocr/complaints. You may also contact the New York State Board of Pharmacy. We will not retaliate against you for filing a complaint.

We may change this Notice and make the new terms effective for all PHI we maintain. The current Notice is always posted on this page and available in the pharmacy.
